My son recently purchased a small boat. After repairing it he went to register the boat and trailor. Dept transport informed him they were reported stolen. He then went to police station and gave a statement. We have learned that the seller reported the boat stolen 1 year ago and was paid out by racq. My son is out of pocket nearly 4k including repairs. It has been over 50 days since last contact with police. Question as the police were fine to leave the boat on our proprty can we legally charge a storage fee to racq to recoup our losses.

Your son may have a right to keep the boat. Did he pay a 'fair price' for the boat?

Do not give up the boat if he paid a fair price. Put locks on the trailer and tell the police without a seizure warrant they can't have it. But give all necessary details of your son's transaction with the purchaser.

If the police do end up taking the boat, do not give up ownership rights and advise the police they become liable if the boat is not returned to you. Get the names and station details of any police taking the boat and a receipt.

If however your son has no paperwork, no contact details, then his position is weak.

Might pay to see a lawyer, possibly a criminal lawyer as they know about forfeiture of property, for some advice.

You are then left with the issue of registration. You may need a court order allowing your son to register the boat.
