NSW Family Law - Will We Receive Compensation if Parents Split?

Hi,

My parents aren't married, but they have 3 kids including me. The property we live on is under my "father's" name and we live with him. If my parents were to split, would my mum and my siblings including me, receive any compensation under family law?

Because I have a terrible excuse of a father, he has hit my mum before, but I've never had the courage to say anything to him. The inverted commas around father is there to emphasise the sarcasm just in case anyone was wondering.

Family law is complex and what you're looking at is the de-facto part of family law. So if mum and dad have been living together for a long time and by the sound of things, they have, then it doesn't matter that only dad's name appears on the title of the house. So it is effectively joint owned between mum and dad.

But you should just focus on being a kid.

Hard to focus on being a kid when you have to put up with pessimistic people when you go home.

I feel for your situation. It is not a fair system by any means and once parents get right up in the roundabout method of the family court process, it is extremely difficult to get out without the courts taking all that is in both parents hard earnt property pool.

I am sorry you are the subject of courts collateral damage. May I please ask, what is your age and how long (if at all yet) your family has been mixed up in court proceedings?
