Him my son bought a car from NSW car dealer on 13/1/15 and he has just found out it was a statutory write off and cannot be registered. So what can he do about it? He is mentally delayed and is on a disability suppport pension, but what I would like to know is, he had to pay transfer through NSW RMS, so should they have said it couldn't be registered? Thank you for any help.

Hi Cindy,

When your son bought the car, did he:
  • Purchase from an authorised car dealer, or in a private sale?
  • Ask about the car's history?
  • Do a background check of the car's history?
Was your son told, at purchase, that the car was written off?

A statutory write-off sale can get complicated—generally, if the vehicle was clearly disclosed as a statutory write-off before purchase, the dealer may have met their legal obligations. However, issues can still arise if there was any misrepresentation, lack of proper disclosure, or misunderstanding of the vehicle’s condition and registration eligibility. It may be worth reviewing the contract and any advertising materials carefully.
