I am currently involved with a matter regarding damages sought following a trespass - a significant amount of land was cleared against the will of the property owner. Aggravated damages are being sought for pain, suffering, mental anguish, humiliation, pain, suffering for the trespass and loss of vegetation. Also being sought are exemplary damages for the respondent's attitude before, during and after the event. We are being asked to provide specific amounts for each component of the claim.
Does anyone know of precedents (Australia wide) that may be of use or some sort of tariff for the destruction of trees and for mental/emotional distress, etc?
This is a pretty complex matter but disturbing matter. Any assistance greatly appreciated.
