Hi,
Firstly this would I expect go under property offences so that the matter matches the experience ( of the lawyer).
This is a very weird matter in that the person concerned use to be a friend of mine for many years but has moved around a lot.
On the 2nd October ( or thereabouts) I had the unfortunate matter of being the centre of attention ( by the Shire Rangers in my area) by having a van which was unregistered on account of having no usable engine for a period of 3 months. More on this later.
I had received a call from my friend after many years on phoning his parents wondering his whereabouts and to see if he had any idea where I could park my van so that I did not have to deal with the shire people. I had been living in the van for about a year due to difficulty in employment etc. Not an alcoholic drugs etc. I told him about the accident I had and I really needed a place to put my van. He suggested a place directly behind his property which could be described as a disused orchard area of about 100m x 100m . I had been there for about 1 week before the shire incident.
Now to the matter at hand:
Due to the move along order I shifted my stuff from the van to my friends property to an area outside the main house ( a small hut like area) which included about 4 boxes and a bike with various important items.
The bike being lent to me by a customer I had.
During that time I met the "property management" a local real estate team and asked the person directly if someone was moving in. They said no, they were just looking at the house. At the same time the phone I was using was essentially not working.
2 days after the above occurrence at 7pm (on a rainy cold night) I was met with all my stuff piled on the verge of his house ! This included computer hard drives, the bike I mentioned and personal items.
On calling him about 1 hour after this I was met by his wife said that I should move all the stuff into my van or car and leave the property. She also said I had been squatting which if 3 days to sort my stuff out includes that so be it, nonetheless because my phone was not working I did not receive any calls ( if indeed there were any) that would have led to a different course of action most likely.
Needless to say, if I had a van or a car that moved this would have been easy to solve!
So, due to putting my "goods" on the verge many items were stolen or put in the rubbish the main being a computer hare drive, a bike ( not mine) and damage to personal items. I have photos for example of an air pump that was either run over by a car or hit with a hammer.
I want to know ( after this story) if I can claim damages ( especially the loss of the bike) and what if any law I may have broken and in short what I can do about this.
I have called him explaining all then above.. Nothing.
Thank you
Bob
