Hi again, I just have a further question regarding a consent order. My ex intends to draft a legally binding contract that we both sign that stipulates that should he default, the contract allows me to garnishee his wages. So my question is this. If he did default, would I need to go to court in order to get the garnishee happening? And if I had a consent order, does this mean I do not need to go to court and can proceed with the garnishee as per the terms of the contract or do I still need to go to court? Just trying to determine whether its still a good idea to get a consent order if the contract gives me the right to garnishee in the event of a default? Thanks.
