I am dealing with a flooring installer who hasn't returned my down payment of $2200
After paying a deposit he sent me an invoice for the balance with a due date of 29 February 2020 (Sent on 18 January)
But on the day before installation (16 February) he demanded full payment before he has even started the work. After a heated discussion (our unit was already completely emptied) we demanded a refund of the down payment, which he agreed to and asked for our bank details. To date we haven't received anything.
Would it be better to take it to Fair Trading or to the Small Claims Court?

Which state/territory are you in? Fair Trading don't usually contact a business unless they receive multiple complaints so VCAT/NCAT/Small Claims may be your best option for a fixed-cost claim.
