Hi, I have a 15 year old daughter who spends every second weekend with me and half of every holiday period. We have a court order that state this. The relationship with my ex had been very toxic in the past and when there are disagreements about the care of our daughter she can be very hard to work with. While there hasn't been any contraventions against the care arrangements, lately there has been some disagreements about how to go about teaching our daughter to catch public transport from my house to her house as she now has a part time job. this has caused some disagreements with our daughter and she has now requested not to come and see me. My ex doesnt seem to care that it is violating the court order and now i am afraid that she wont go to handover with my daughter and means i wont get to spend time with her. I want to know what recourse I have here in SA. If i apply for a contravention order through the courts what do i need to do prior to this? how many missed handovers do i need to wait before i can take action? do i need to go to mediation before applying for a contravention order even if there is a court order already in place? how is the contravention order then enforced if my ex continues to not take my daughter to handover?
