I am Indian need to immigrate to Australia

Hi .I am Indian and want to immigrate to Australia I am married but we are not leaving together.And we are planning for a legal separation .She is not willing to sign any documents or go medical test. Is an affidavit from my lawyer is enough , saying that we are not living together and not interested to include her as a dependent.Will the Australia immigration will accept it .
