Hi.
An Indian friend of mine who has a Permanent Residency has married in India woman and brought her over on a bridging visa about 23 months ago. The marriage is going through hard times and it does not look like it will continue. They have separated. He contacted the Department of Immigration Australia in March, 2014 and notified them that he no longer wants to support her for PR.
2 weeks ago she took out and intervention order against him because she feels threaten by him. She left the premises and is now living with friends.

The questions are:
1. Is she entitled for legal aid not being a PR?
2. Will she be entitled to the husband's property (unit) even though her name is not on the mortgage papers?

She had worked for about 6 months whilst she was here earning a minimum wage.

Thank you

They were married together in India about 18 months ago. The marriage was never registered here in Aust. He will begin divorce proceedings via the Indian courts in India.

It was purchased before she entered Aust and before they were married. She had worked for about 6 months whilst she was here earning a minimum wage.

Thank you
