I share executor privileges with a brother who is to some degree mentally handicapped. The estate has shares which due to his interreference have fallen significantly in value. He has been secretly trying to sell the shares without informing me. Given he cannot act alone, and his role is to maximize returns to the estate and not his own pocket, can I lay charges against him or at least have him removed as an executor?

No. Police lay charges, all you do is make a report.
Yes, you can apply to have him removed for breach of duties in the Supreme Court of NSW.
