Hello there.
I have a question regarding an AVO. There is an additional restriction of AVO where the defendant cannot come in within 100m of the protected's house. Protected has appealed to get this restriction removed so defendant can come live at home. Once magistrate approves this, can defendant make a choice not to come home or can the court or police order them to return home?

Hi there,

If the change to the AVO is approved, the defendant won't be ordered to return home. If there are children involved then child support payments may apply if the parents are separated.
