They will never die out because there will always be off street parking spaces to exploit nobody will ever make the same mistake twice usually but I think there are still many unsuspecting parkers out there who have not yet been done enough to keep them in business for a very long time unless something is done about it.

The line they always keep repeating is "You should not have parked there! " Yet they are smiling all the way to the bank because I did park there. The reason why the tow truck drivers prefer to wait there until you arrive and just leave the car semi hooked up is because its less work for them and they get to pocket the cash into their own wallet instead of it all going to the boss.

I don't see how a business will survive if the whole thing is run by thieves the only reason why they are doing so well in Brisbane is because there are no guns. If this was going on in the USA all those tow truck drivers would have been shot dead by now and that tow truck office was not bullet proof it was made of tin, one drive by robbery and it's goodbye Brissy Towing.

Anyone reported them to the ATO? Doubt cash money is going onto the official books. Send your receipts to the ATO if you pay cash.

Extorted $660 last night in McLachlan St 8:20pm for a 5 min parking duration. Have visited Cactus Towing FB forum and left contact details.

I
I got stung today at the car park on Mclachlan street. $660. Just a thought my car never actually got towed as I was back when he had just put the chain on the car to start putting the car on the tray. Does this still count as being towed or am I technically paying for a service i never received?

I was told forcefully that I had to pay the fine or he was going to tow my car. I tried to reason with the driver but he just got angry and brushed past me to start the tow. I had no choice but to pay him. Another thought is if i jumped in my car before he had it up on the tray and called the cops what would the outcome be then.

Hindsight I suppose but just a thought.

On the paperwork it states car first sighted at 12:19 and i looked at my phone when i rocked up and it was 12:21! How can you possibly justify that amount of money for not even towing my car. If you don't laugh you'd cry ha.

Any help would be appreciated. I have lodged a complaint with fair work and emailed the company which I doubt I'll hear back. I can appreciate a fine maybe but that amount of money is just daylight robbery.

I had the same experience from this mob in the same spot. They lease the parking - not employed by the companies as 'Billy' stated - the companies only lease their bldgs. and do not employ these thugs - yes they are not intelligent as their paperwork consisted of irregularities - 'Billy' would not let me read it - all they made me do was sign the form without being able to read through.

I believe they have CCTV monitoring to enable them to jump at any moment and hook you up then extort money and charge the full amount for towing the vehicle without even towing it. I really would like to get together with anyone who is able to help fight this ridiculous unrealistic behaviour.

It is again WHS regulations for them to tow a vehicle with anyone in the car - hence they forcefully fight to try prevent you from getting into the car. They are also aware that as it is so called 'private property' (since they lease it) the police cannot do anything.

Correction to above response should read 'against' WHS regulations. 'Billy' and his mate 'Reece' boasted about getting such good wages for doing their jobs, 'Billy' is not a Christian, has a wife and kid to support. Well Boo-hoo....! What about the people they are extorting money from?

They are heartless and do not care about anyone else not their personal situations.

Try to book appointment with LegalAid Queensland guys, free law advice - go see them soon since they are closed during Christmas. Get your case looked into and then lodge a dispute with QCAT. Can't guarantee a win but if you are using form 3 application for minor civil dispute- minor debts an application cost starting from around 25-65 dollars.

Cheers

I have tried booking an appointment with Legal Aid - Caxton / Inala / Ipswich - all closed for the Christmas. Will follow through with QCAT.

Thanks.

Yeah you are right, JohnnyChristo, thanks for the help. You might be able to add my 450 to your 6600 soon. I also have pmed Jimmypatto and I hope he will get back to me.We both got stung by the same company after all.

Hey mate, I never received your message? I'll give you all the details.

Basically you will need to serve an Application for minor civil dispute with your local Magistrate ($30). Because these dogs operate outside of the law they refuse to acknowledge emails and posted letters so you will either need to serve in person (Turn up at the door, with a person to video the encounter) or fill out a form for substituted service.

Basically this eliminates the need to attempt to serve these bastards yourself. As they operate without a business address, this application will be approved instantly. The Adjudicator then files the notice as served and makes a decision based on the facts. once the decision has been made the lowlife scum have 28 days to rectify or the matter is then chased by the court. Be sure to include the interest when calculating the amount owed to you as no doubt they have left you financially hindered.

You will also be eligible for reimbursement of any costs incurred, ie. taxi fares etc. If it goes to court I suggest getting your car checked over by a mechanic for damages caused from the tow- If your car was an automatic left in park no doubt your transmission was compromised.

Also go see a doctor and state that the stress of the ordeal has caused mental anguish (I'm sure it has) and get him to write a letter to provide to the magistrate. You will then be eligible for compensation. it may take a while but you WILL win. I encourage everybody to do this. And report the the Office of Fair Trading ASAP! It's the only way these scumbags will learn.

Will do mate, thanks for the thorough reply. Not sure if my outcome will be the same as yours, but I shall do what I can
