* family court proceedings are around a year in -
* father has been subject to many false allegations of drug use/ mental health issues / family violence. - VRO Gained by lying about these accusations
* Magistrates have now deemed father no risk (after 40 supervised visits and a glowing report ), several negative drugs tests, Case assessment recommendations and no evidence provided by respondent Mother.
* Mother has missed numerous court events due to illness (both her and the kids) and has been identified by CAC has being obstructive.
* eldest child now in therapy for apparent anxiety of seeing his Father (although supervised report shows he is absolutely fine) Mother has allowed child to miss 5 of the last 10 visits and a contravention order is due to be filed this week
* Spend time is meant to be 5 hours a week (plus more if parties agree - Mother will not allow) - but these are regularly missed
Current Issue
Mother is a Nurse and is extremely over protective with medicals - but will not share medical concerns with Father - despite court ordered to do so.
resulting in the medical records being subpoenaed - from two medical practices - one in which she works - only one has come back but the amount of appointments / test and examinations for children are concerning - ranging from MRI's / EEG / Apparent Broken Neck - all come back with no findings of sickness - but ongoing appointments/illness's are brought up
After inspecting the medicals two things have come to light so far :
Mother has obtained medical certificates to get out of turning up for visits - which, when cross referenced against actual records do not match
(potentially used medical certificats to get out of court hearings to - TBC in the next set of records due to filing today)
Mother has been giving youngest child (2) non prescribed Drugs (most probably stolen from work) - Cancer treating Pills for Nausea when patients are going through chemo
hearing due in two weeks as mother has filed a 'application in a case' to over rule Fathers decision to take youngest child off waiting list for surgery for a sickness he doesn't believe he has (having his tonsils out) - so a opportunity to bring up this new found information
Questions:
How do we approach this?
Is this as bad as we believe it to be and will the court make a decision on where the kids live based on this?
is this classed as abuse - should it be reported?
is it wise to ask the court to order Mother to have a psychological examination due to the harm this behavior could cause the children, health and emotionally
can Father order that Child is taken out of Therapy - as he has states several times he doesn't agree and has requested that both parties should go to mediation before children are forced to go to a phycologist
any advice would be greatly appreciated
