How can a group of 70 people (from all states in Australia) or more recover monies $4000-5000 paid to a seller on Facebook. She is ignoring requests for contact or refunds after many many requests. No goods have been received. We have advised police and reported individually to acorn.

Hi Kathleen Jones,

Is the seller an Australian business or a private seller? If they are an Australian business, you may have recourse under Australian Consumer Law. Have a read of these articles for more information about the ACL: Australian Consumer Law Guarantees - How Can They Protect You - Blogs - LawAnswers.com.au and Consumer Protection: What To Do If Your Australian Law Guarantees Are Breached? - Blogs. LawAnswers.com.au.

If they are a private seller, then you may have to sue them privately, either as a class action (all 70 buyers represented by a few people, suing together) or each individually. This will depend on why you are all seeking the refund. Were you misrepresented by the seller? Were you defrauded by the seller?

Thank You Tracey, she is a registered business in WA but sells online on Facebook. We have now lodged reports with Acorn and Fair Trading complaints. Thank you for your response.
