Myself and my partner are looking to providing live sex shows for financial remuneration at our private residence or that of the client.

It is unclear if this would be classed as prostitution / sex work as there would be no physical contact what so ever between ourselves and the client.

If this is classed as prostitution we would not be able to do this as private sex worker laws prevent more than 1 sex worker being in a private residence at any time, and bookings with more than 1 sex worker are also illegal.

It’s also unclear if this falls under the adult entertainment industry laws and I can only find information stating permits are required on licensed premises, nothing about conducting this in private at your private residence.

We would also not allow filming / photos as this this would also then be classed as illegal pornography.

Any guidance on how the law would view / categorise this is very much appreciated.

What you’re describing will come under prostitution. Per the Queensland Criminal Code, prostitution involves intercourse/oral sex/masturbation on another person under an ‘arrangement of a commercial nature’ (I.e. payment). There’s nothing that requires the person receiving the act to be the one that is paying.

Adult Entertainment Permits specifically exclude intercourse, oral sex, and masturbation.

If you are renting instead of owning your own home, then you need to take that into consideration as well.

If renting, you may be prohibited from using the residence for business purposes. You have further issues if you use the residence for illegal purposes.

I'd suggest you retain a good lawyer in the entertainment industry who can give you some advice on what is considered the bounds of pornography, and what is legal in terms of that space in Queensland. You'd be looking for someone with specialist knowledge and experience, so I don't imagine it will come cheaply.
