I have a trial coming up over property matters in the Family Court. I have learned that the ex has put everything in her adult child's name (child from her previous marriage), including her business operations, effectively giving the appearance she is unemployed.

Can I subpoena the banking and business records of the child?

When did this happen?

There are rules in the family court around full & frank disclosure...

(g) any disposal of property (whether by sale, transfer, assignment or gift) made by the party, a legal entity mentioned in paragraph (c), a corporation or a trust mentioned in paragraph (f) that may affect, defeat or deplete a claim:
(i) in the 12 months immediately before the separation of the parties; or
(ii) since the final separation of the parties; and
(h) liabilities and contingent liabilities.
