Well, that sounds more like a fishing expedition to me if they can push through a case they didn't even have in the beginning...
Like I said above, part of the skill of a prosecutor is
to bring the most appropriate charge, given the facts and circumstances of the case.
The facts and circumstances ("evidence") which inform this decision
can and do vary with time.
