My Ex husband lead me to believe I had to pay half of private school fees for our child (which I did) on top of an agreed child support arrangement. Can I sue under family law him for the return of this money as I have since found out that I did not have to pay on top of the support amount? The fees were paid back in 2009/2010.

If you agreed to it, you'll struggle with your case. The court will hold that it's your responsibility to research the deal before agreeing to it. Further, if you agreed to the choice of school, the court would likely order you to pay half the fees anyway.
