Hi,

I currently have a 10-year AVO against my ex who is serving time in prison for Domestic Violence related offences against me. I have spoken to my lawyer about seeking Sole Parental Responsibility and custody of children, however, she doesn't advise this as it opens up an avenue for him to gain contact with me through access with my daughter...

Child Protection have already deemed he is not allowed contact with her. I'm just concerned that there are no orders in place, is the AVO enough?

hmmm a few issues.
Yep a 10 yr avo and jail time is gonna help. Atleast for the next 10 yrs. Sorry to hear about your situation. I think moving away, getting a new life away from the area would help you move on...
BUT - What if you want to travel OS? you'll need dad's signature on the passport application. Apart from that I reckon you're off the hook...
