How to access professional indemnity insurance, when no money!? Can you tell me how a person on a pension can get justice? I was damaged by a psychologist. She later suicided. I have been informed that I cannot claim on her professional indemnity insurance because I am not rich and have no physical damage.

The psychologist was investigated by NSW Health Care Complaints and APS. They tell me to go to her insurer, but I have no riches!! These insurance companies have it made. No-one but the rich can claim. Where is the justice?

I was told to contact a certain law firm and that they might do it no win no fee. But the solicitor said I don't have $40,000 damage, so it's not worth it. So wrong.

Apparently emotional harm does not count - only physical. Why can these professionals have insurance, if they are unaccountable for doing damage???

Personal injury law in NSW is a complex area of law, especially where only emotional harm (and no physical injury) is involved.

"No win, no fee" lawyers generally consider each matter on a calculated risk vs reward. That is, do they risk their time and money upfront to receive a return if your claim is successful. Like other business models, they operate for profit. If you've only consulted with one law firm, perhaps consider contacting another "no win, no fee" law firm for a second opinion?

Thankyou. I have contacted two. Seems they will only consider physical damage (not mental/emotional or professional misconduct). Also they stipulate that the physical damage must be at least $40,000. It just seems that these health "professionals" can get away with anything.
