Hi all, just enquiring on behalf of family member:

"I have damage inflicted on my property (wooden fence) by a well-known delivery company. I had evidence of the damage and license plate of vehicle so the company has agreed to compensate, however they've been stalling and the case has been open since 2017.

I've now been informed that their insurance company will not reimburse me for the full amount of a new section of fence where damage occurred but only a certain percentage of compensation due to the age / condition of fence.

Im just wondering what my rights are under law (the property is in WA and their insurance company QLD) and whether I'm entitled to 100% of the cost of replacement of damaged section or I am at a financial loss with having to also contribute to the damage they caused to my property?"
