Hi,

My question is what happens to a respondent who hasn't submitted any additional Affidavits, any legal arguments, agreed findings of fact, any further submissions or objections to an Applicants Evidence by a certain date as ordered by the court. The court has also ordered that the respondent be precluded from relying on anything if not submitted by the court ordered date. The date has passed and a final hearing date has been set, What can the respondent do to get their submissions filed with court if that is still possible??

one of 2 things will likely happen:

1. They file late. You can then either agree to proceed or request an adjournment and request costs.

2. They file nothing. You then request a summary judgement. Which can later be appealed.
