Hi l am in Victoria, my home was built 8 years ago, l recently discover water damage to the bathroom subfloor, l put in an insurance claim and they said it was rejected due to faulty workmanship by the company that built the house, they said they didn't properly waterproof the bathroom, l also have a plumber and builder that agrees with that so l have strong evidence. The contract paper l had with the building company said the structural guarantee is for 7 years , but the house is 8 years old. Do l still have a claim against the company under the implied warrnanty of the domestics building contracts act which has a ten year time limit ?
When l contact the building company should l ask them to pay for the cost of the repairs or should l ask for their builders to do the repairs at their own cost?
