Verbal contracts are hard to enforce even with witnesses and agreement, as the terms of the agreement can be hard to pin down. That's why contracts should always be in writing wherever possible.

When the parties disagree about the existence of a contract, and there's no concept of consideration passing between the parties? Nothing's impossible, but it would be a very hard prospect. Especially when there's no concrete promise.
