A friend has been slapped with an AVO by the police unfairly. He wants to oppose the AVO in court. There’s good evidence to support him.

If he hires a barrister and wins, can he apply to the court for the costs of his legal representation to be paid for by the police/state?

If so, what’s the likelihood that his full legal costs will be reimbursed?

Nope - not much chance of getting a cost order. Sadly, my advice is to accept without admission. WHY?
1. It costs $0.
2. I'm aware of some cases where a 12 month interim avo took 15 months to get withdrawn at court. That means if he accepted without admission it would have ended sooner than the time it took to contest it.
2. If there are kids involved use your money wisely. Getting the avo revoked still doesn't give you access to the kids.
