What's the minimum penalty for stealing a motor vehicle (371a criminal code) in western australia, asking for a mate cause his lawyer is not helping him with his case and the accused was under the influence of drugs and says he cannot remember the incident. Which I know is not an excuse but he would also like to know if his penalties would change if he was to put himself in rehab, he also has a full time Job and also has a child on the way

As far as I know, there is no minimum penalty for s 371A offence. Most offences do not have a minimum penalty as this is seen as an extremely severe measure reserved for very serious offences.

In order to get the minimum penalty, the first thing to do would be to ensure that there is no financial loss for the vehicle owner.

The driver was also under the influence of drugs at the time, which would normally be another charge (sounds like no proof, so no charge).

Get hold of the vehicle owner. Ensure that he/she has been compensated. That shows remorse, and there will be no need for an order for restitution. This will also greatly increase the chances of getting a spent conviction (if one can be applied).
