Hi there, I have an employee that received a Penalty Notice due to driving an unregistered vehicle over 4 tonne which also warrants a minimum of 4 demerit points. Problem is the truck is leased through a finance company who was responsible for the registration of the truck. The truck is only 12 months old and the finance company ask us to get a safety certificate so we booked into the Roads Authority. They turned us away because the vehicle was only 12 months old. We let the finance company know. It was then discovered after the fact that the truck needed a pink slip not a machinery inspection which was obtained. Vehicle was registered 4 days after the Penalty was issued. Finance company takes full responsibility for the Penalty however the driver still has to cop the demerit points. Can we do anything at all with the demerit points??

Depends on the circumstances. If the stuff up led you to believe that the vehicle was registered when it actually wasn't, then you might be able to do something.
Contact RMS first and find out your options. Ask if a Statutory Declaration from the lease company will help and then take it from there.
If RMS agrees that you had a valid reason to believe the vehicle was registered, then they might restore the points.

I spoke to a really helpful women at RMS and she has explained bottom line that any driver of any vehicle is fully responsible to ensure the vehicle they are driving is registered. She said you may be able to fight this with legal assistance but doubted any change to the demerrit points. Thanks again for your help Scruff.
It was a long shot. But I must say that with no rego stickers anymore, it's a but much to expect drivers to know what's going on when someone else is responsible for taking care of all that stuff.
That's just not being realistic - hardly anyone driving a company vehicle would have any clue at all if it's registered or not.
I guess getting rid of rego stickers is just another in a long list of of money making scams by our governments.
