Hi

My question is, if you use a child as a pawn to hurt a partner, even before separation took place, eg. making child stand in-between two adults while arguing, telling child that when she gets a husband, boyfriend that you will be abused & mistreated because that's the way it is & consistently telling child that other partner is no good at all, despite everyone arguing that it is far from truth.

Is that abuse of some kind under family law?

In the context of family law proceedings, it's more likely to be distinguished as a lack of insight about the children's emotional needs, more than anything else, which is still a s60CC factor in deciding what's best for the children.

What course of action are you considering here?

I'm not really sure how to go about things. I do know for certian that I don't want my daughter having issues later in life, like behaviour patterns like my ex & her mother. I have argued for years that it is not good for kids

You're in a no-win situation. It is very unlikely the child will be removed from such a situation. So you're better off showing how well you can work cooperatively with the other parent in the best interest of the child.

Thank you for replying, everyone. I thought that might be the way to do it. It breaks my heart the hurt & suffering my princess will go through as all this gets sorted & afterwards But thank you for your input, it is appreciated

Bringing a child into an argument could certainly be seen as a form of emotional abuse. So too could it be said, perhaps, that while one parent's behaviour is to a worser degree, in this regard, than the other, that both parents have lacked a certain amount of insight into their child's needs. After all, an argument involves more than one person and both have exposed the child to the argument. One parent could have taken an action to avoid the child being fully exposed perhaps? Walked away?

Has this behaviour of the child's mother decreased or ceased since separation?

I do understand that it takes 2 to argue. The thing is I did walk away before it got to stage of yelling. It would worsen. She would then follow me into our room, then continue hurling abuse the whole time making my daughter witness this.

I am not saying I am perfect. I would never make my little princess go through such a thing. I have yelled at my ex after hours of coping it but never with my daughter close by.

Don't worry, it had happen many times with family friends around .

Sorry as for mother's is behaviour decreasing. She won't let me contact my daughter.

I had flowers and chocolates, things like that. Just wanted my daughter know how much I love her & that I am thinking of her. Ex is trying to stop me from doing that

So you're not seeing your daughter at all? How old is your daughter? Do you have any Court orders in relation to spending time with your daughter? If not, have you made an application to the Court for parenting orders? You should really look into doing this sooner than later.

My daughter is 5 &I haven't seen her for a month. I have ball rolling for mediation app next week. My ex has always been jealous of my relationship with my daughter.

My ex abuses me to no end. She just doesn't like the fact my daughter & I have a healthy happy relationship
