Hello,

I just wanted to get some information about submitting a video as evidence in a parenting orders case.

What is the procedure? What format is it best submitted in (CD, USB, etc)? As this case is still only at interim stage, is it best to leave such submissions until affidavits are sought for a final hearing?

Thanks in advance.

Hi @AllForHer,
I'm not an expert in family law but where I've had other court hearings using technology to present evidence, I've generally contacted the court's registrar before the hearing to confirm the technology (e.g. Internet access, DVD, VCR, etc.) that may be available in the courtroom.

Hope this helps.

That's great, thank you very much. I am hoping we won't ever have to use it, but you never know.

Important also to remember that it matters what the video is of.

Cheers, Tim. This particular video wasn't filmed in secret - the mother has knowledge, and indeed, a copy of it. I'm hoping it won't need to come to light in this parenting orders case, but it's impossible to tell which way things will go - the respondent mother seems to think that the father saying "I am going to organise another mediation session so that we can try and reach an agreement outside of court" amounts to "threats and intimidation", so who knows?

Thanks for the info. Much appreciated.
