Hi,

My brother-in-law was in family court last week to finalise a property settlement after three years. His ex-wife has 30 days to buy him out on the family home. It has been a very bitter divorce.

How can he ensure that she will not have claim to any further income he might receive in the future. ie redundancy, etc?

If the property settlement has been finalised, she won't have any claim to assets gained after the date the property settlement was sealed. The only variant, I suppose, would be if they have a child and he is assessed to pay her child support.

Get divorced and make sure he has a will that excludes her. Once property division happens, he is pretty sorted but if he drops dead while still married, or while he doesn't have a will she could still claim to be next of kin. A will should sort that

Thanks-they divorced Oct 14, but l will definitely let him know to wipe her off the will, if he hasn't already.
