I recently sold a car privately.
Buyer sent a letter from a lawyer saying that I mislead him by not disclosing issues the car has when asked. That I removed receipts and service history from car for mobile inspection in order to hide knowledge of issue.
He says car needs new transmission and will cost $4-5000. He is asking for $2000 or may sue me.
Notes:
1. The issue was spoken about with him, mentioned the recent history with mechanic trying to find issue (warning lights on car), mentioned to him what they did (auto transmission specialist to mycar to check transmission) which included resetting and changing over a solenoid, the issue then ceased.
2. I had spoken with him about transmission, he told me about car issue when driving back to NSW (from VIC) and I spoke with him at length. He then asked for $1000 towards repairs. I think we spoke on the phone maybe 6 times before and after the sale. After getting the last text from him asking to speak I said I don’t have time, but can text if he has questions.
3. The letter from lawyer has a couple of incorrect (read: lies) in it.
4. If I was really hiding, wouldn’t I not have given them copies of mechanic reports?
5. Service books were removed from car along with everything else during inspection/other test drives. Inspector didn’t even ask my wife for receipts or service history. I mentioned that I had full service history to buyer, including disclosing recent history to him.
Unsure what to do.
