My mother has gone into a nursing home and her asset test shows her having around $300000 but she gave $220000 of that to my younger sister to buy a house which they would both live in. The Department Human Services (DHS) says that's a gift and still part of Mum's assets so the nursing home is charging her an extra $400 a week for accommodation. Mum doesn't have he cash to last a long time there, she is 85. My sister is not speaking to me and will not pay the extra money as it is in the house. Department of Human Services told suggested I seek legal action and maybe a caveat of the house to get the money back for mum..
