Hello all,

Is finding money in the floor and keeping it synonymous with theft as defined in the Crimes Act 1914? Would greatly appreciate any help I can get. I typed out details of my case but cannot create the thread as it says my content looks like a scam.

It all depends on circumstances - the amount, where it was found etc. Hard to tell without more information really

I found it on the floor of Melb Crown and now I'm barred for 12 months for keeping it

So are you asking whether they could ban you for it or whether Police could charge you for it?

It is a unique case, but I think your case would fall down because it was chips and not cash. Obviously chips are not legal tender and once you exchange cash for chips, you don't have $500, you have $500 worth a chips to use within the terms and conditions are stipulated by Crown.

You also don't own the chips, you have a right to use them while in the Casino, but Crown remains the ultimate owner of the chips. So yes, technically you did steal from Crown, and they would be within their rights to ban you. If it was cash, different story, but unfortunately it wasn't.

It wouldn't be a criminal case I don't think, maybe could be considered fraud if you were caught after or attempting to exchange the chips, but if they were in your possession I wouldn't worry about it.

I'm a regular at their poker room and do quite well on a regular basis so am thinking of fighting the ban

You could plead ignorance to the terms and conditions, but they would be letting you back in out of goodwill and not a legal obligation to do so; they can refuse you for as long and for whatever reason they want. You cannot force them, legally anyway, to let you back in. Write to a manager, explain the situation and that you were a 'few drinks in' and remorseful for your oversight. That's what I would do anyway.

It was cash! Five notes of a hundred. But their letter barring me was on a basis of "chip theft". It was not chips!
