Hoping I could get some advice.

My partner has just found out the mother of his son has been incarcerated
What grounds does he have?
She has current court orders with CPS. Difficult situation as there's been DV history between both parents. He is currently seeing a family lawyer.

Without more detail it is not possible to say. Is the son living close by? Was there violence involving the son or mother or both? Any contraventions of IVOs? Involvement by police?

If there had been no violence it would have been easier to predict getting access to the child but violence is a huge factor and may mean your partner will not gain access.

What are the current parenting arrangements?

No one can incarcerate anyone. Your partner should take help of police and court.
