Hi
My partner's dad gave him a heap of tools and equipment for his business. Things are not good between them now so his father wants all the tools back. His dad has been to the police and now we receive documents from the court, he is trying to sue us for the cost or return of the tools. Where do we stand under property law in terms of all things he is claiming were gifted to my partner which he uses for his business? What should we do?

  1. Does your partner have any evidence (notes, text messages, emails, etc.) to support his belief that the tools were gifted under happier circumstances?
  2. How much are the tools worth?
  3. What documents did you receive from the court?
  4. Which court are the documents from?

We have no written evidence that he gifted the tools to him. His dad is claiming the value is $6000 but my partner doesnt believe they are worth more than $1500. We got the documents from Beenleigh court house and they are titled application for minor civil dispute.
