i was hoping that i would be able to file a lawsuit against ex partner as family law court could be a problem as she has alienated me from our 3 children
Lawsuit as in suing, civil court? .... No.. because it's a marriage/relationship, property/assets come under the jurisdiction of family law ... That is the only court that can help you (apart from point 3 in earlier post ..

Regarding the kids ... If you want some advice/opinion on that matter, start a new topic

However, with no application on foot (he's inside 12 months),
maybe what we are really talking about is plain old stealing.

Two points ....

The 12 months only applies to divorce... property settlement can be filed anytime after separation...

Cops wouldn't even give him the time of day as soon as domestic relationship is mentioned... No 'stealing' in domestic relationships :rolleyes:
