I have just recently moved into a flat in Sydney and I was questioning the definition of excessive noise. I have muscle pain from working as a night filler last year and I find a hot bath relaxes and soothes the pain, but I would have baths at all hours of the early morning when I lived with my parents (3am even).

Considering I don't want to receive a complaint from the people renting in the building, would running a shallow bath be considered an excessive amount of noise at say, 4am? The walls are solid brick but sound travels a lot in these stairwells.

Many thanks for any answers.

If it disturbs someone's sleep on a regular basis - yes.

Consider putting something in the bath as a sound deadener, or running a rope from the tap outlet into the base of the bath so the water runs along the rope and makes less noise, or plastic hose that fits over the nozzle.
