HI, A friend of mine was the executor of a will. Upon the death of his mother his sister contested the will, but she did not gain anything more in the attempt. The will was then executed, monies distributed and certain property was willed to her and others within it. This was more than 2 years ago.

She received the money willed to her, but has since said verbally that she wishes to re-contest the will again, and has not picked up the property willed to her because of this.

My friend has been holding that property for more than a year now, and has received no legal notices in regards to re-contesting or further court action. She has so far refused to take contact from him, does not return mail, and had previously only contacted him via his lawyer, which he no longer has.

He is wondering what his legal rights are in regards to the storage and holding of the property. Is there a timeline as to when he can dispose of it, or send it at her expense etc? Is there a timeframe that she must re-contest within? When can he consider this all to be over?

The property amounts to a car, and various other items contained within the car that were personal to his mother so not easily sent/transported.


Any advice would be appreciated,
