Hi, my dad recently purchased a 2010 Mitsubishi GLXR Triton for me. After 6 months, we have realised it's not even a GLXR model, it's just a GLR and they have replaced the back tray and bars with a GLXR back tray. We have had nothing but problems including a blown diff. We are just wanting to know what we can do under Australian Consumer Law. Can we demand our money back? Or can we demand the original GLXR we wanted?

Hi there,

Who did you buy the vehicle from? A private seller or a dealer?

What is the GLX? Is that the same as the GLXR or the GLR? Or it a different model again?
You are entitled to receive the model of vehicle that you have been told that you would receive, including any of the special features that a particular model or accessories option may give.
You are also entitled to receive a vehicle that is long lasting, in consideration of the age and type of vehicle.
So on both these grounds (wrong model and faults) you are entitled to go back to the dealer and ask for it to be fixed (in the case of the faults) and to receive a remedy for receiving the wrong vehicle. That may for example be exchanging the car for the model you were told you were buying or receiving your money back.
It is up to you whether you go straight back to the dealer and ask for the car to be repaired and negotiate how to resolve the issue of receiving the wrong model or if you want you can call NSW Fair Trading first before you talk to the dealer.
