On the 21/12/2021 I was at my local community pools with my son & some of my family members. Around 4:30pm this lady that also lives in the community area scans her community pool card to let herself into the community pool area as she proceeds to walk over to the pool, she is staring into the pool as if she is looking for someone. As she approaches the pool she proceeds to tell this young girl aged around 12-14 years old to leave the premises as she does not have a community pool card with her at that time & proceeds to accuse her of not living in the area as only people in the area (5 visitors per card is accepted) are allowed to access the pool & amenities. The young girl is crying & so embarrassed as there is a crowd of people in & outside of the pool staring confusingly at her, the lady then proceeds to kick her out for no good reason. I then proceed to get out of the pool myself & help the young girl as she is basically shaken & does not know what to do. I suggest to the lady that she doesn’t need to do this to a child as it is a 30+ degree day & she is just a kid trying to cool off on a hot day. The lady tells me that she pays for strata fees (everyone that lives in the area & wishes to use the community pool & amenities pay those fees) that keeps the community pool clean & in everything in and around it in good condition. I told the lady that the young girl is only a child but she does not seem to care & still proceeds to kick the child out. I then tell the lady to leave as myself & many others think this is just very unnecessary. She then proceeds to tell me that she saw 2 kids jump the fence to use the community pool & mind you there was about 10+ kids there including my own & my younger family members. I proceed to tell her to leave as she is causing unnecessary drama with no proof that it was any of the kids that were present at the pool. I believe she racially profiled this young girl who is of Pacific Islander appearance & the only coloured child other than myself, my son & young family members. I still proceed to tell her to leave & as expected she does not corporate. She then proceeds to threaten to call security on the young girl. The young girl leaves confusingly with tears rolling down her face. I approach the lady & tell her what she did was not right coming to a community pool to terrorise children that have done nothing wrong. She then starts to give me racial comments about myself & my son. I do not what so ever take racism to heart as I have dealt with it my whole life. She then makes nasty racial comments about my son to me & I just lose my temper. I proceed to hit her with a closed fist many times & as expected she also done the same, I am now being charged with assault occasioning actual bodily harm as I threw the first punch. I’m not the type of person to be in any kind of physically violent situations or any trouble in that matter. I am a first time offender, never done anything bad in my 21 years of life. I just want to know what are the possible outcomes for my actions? & can I lose custody of my child as I am a single mother being charged with assault causing actual bodily harm?

Ok criminal matter? look, likely you're gonna get a section 10 bond. Bascially a warning....
Lose your child? nope -stress less.
I'm gonna make an assumption and SORRY if I am wrong. But if you're Koori - then speak to your local Aborgianal support group, I'm sure you'll find you can speak to a solicitor through them at no expense. But don't stress about losing your child.

I'm gonna make an assumption and SORRY if I am wrong. But if you're Koori - then speak to your local Aborgianal support group, I'm sure you'll find you can speak to a solicitor through them at no expense. But don't stress about losing

Your reply has done me some good well in my head anyways ahahaha as I tend to overreact a lot. Also no im not of any Aboriginal or Torres Strait islander background. I am Pacific Islander so Samoan lol. I’ve been told by local police that I can get legal help through Legal Aid which is what I’m doing. Just wanted an opinion off others to see what I’m up against. Thanks so much
