Just wondering if anyone has had any experience with the Family Court with their children. The current situation is that the children see their father every weekend (Friday night to Monday morning). This has been occurring for over 6 months, as a result of a verbal arrangement with the parents. The mother is refusing to sign the Form 11 to make it all 'formal' and is deliberately stalling the matter.

If the father files a Form 1 with the Family Court to get the current arrangement formalised, is it likely that the judge will reduce his time with the children down to every second weekend? Their is no valid reason for a reduction in time however. I just wonder if anyone has had any experience with a similar situation.

It would be likely that the court would enforce the same amount of time as what has been continuing as per verbal agreement as the court looks to what is in the best interests of the child and usually that would be following the same routine If it has caused no troubles previously.
