My car was towed to a mechanic 12 weeks ago requiring a head gasket replacement they took on job but have had problems getting the part firstly, then once they found part had trouble putting car back together. I'm assured it is now back together but they are unable to get it to start during this 3 month period I have had the loan car to get around. I am at a loss to know what to do every time I ring I am given an excuse and I have asked repeatedly for the boss to call me as he is either not there or unavailable.

What are my options under Australian Consumer Law, if any?

For example, do you want your car back? Do you want to reduce the amount you pay the mechanic? Do you simply want the manager to call you and explain the situation? Or do you want to take the car to another mechanic to get a second opinion?

From the information you have given, it sounds as though your vehicle has serious issues and that may not be the fault of the mechanic. Has the mechanic called you each time something comes up and obtained your approval before doing any more work/ buying further parts?

The steps you should take now depend on what you want from the situation.

Aa I am still paying car off I owe approx $ 16,000 I would like to not have car back and be written off to insurance I feel if car is eventually repaired I would have no confidence in its safety the manager as not once returned my calls or been available to speak to me the car went in to be repaired with only the head gasket to be replaced but as the assistant told me over phone they did not know how to do it as they had never done one like it before and could not get it back together then when it was done couldn't get it to start . All this has been going on for 3 months !

Hi there,

If you want it to be written off by your insurance company have you called them and notified them what is going on?

Is this a small shop or a franchise or dealership?

Do you have somebody that is good at getting what they want that could go to the mechanic and see if they can sort it out.

I don’t think you insurance is going to be interested in this. But anything is worth a go.
