Hello Guys,

I have purchased a 2008 BMW 335i on the 2nd of June. The vehicle was 85312 km when I purchased it. I went to my local mechanics and he saw a re-gas sticker in the engine bay. The sticker was showing 165002 km. I have contacted fair trading and present a copy of the ad, receipt and seller details. I also purchased a history report from https://www.carify.com.au/ and present the Fair Trading officers. The report provides full odometer history until 2016 as 100121 km. Who knows how many km within +5 years?

The catch with this is I'm being told they need my car to the vehicle identification unit in Botany NSW. Their operation is very limited due to the current situation and I have been super tired to wait and resolve the matter.

I would like to sell my vehicle and I already know that I am not able to sell the vehicle with 85xxxkms. What is the best way to sell my vehicle and end this nightmare? I am going to lose a fortune with the sale of my vehicle. I event don't know what is the actual mileage of the vehicle except the history report and a gas sticker.

Is there any chance to sue the private seller? Any assistance and tips will be greatly appreciated.

You're going to have to do it at some point.

2. Your prospects of success in an action against the seller depend on how good your evidence is.
That includes the History, and the evidence (probably given in person) of the mechanic.
