Paid solicitor to amend claim by certain court ordered date as agreed

Solicitor failed to provide amendments by that date. Relationship broke down because he failed to perform duties as agreed.

I then filed claim a week late. Voided by court registry as out of time. Directions in coming week.

Do I have any rights against solicitor if:

A.) I get costs order against me.

B.) The claim is dismissed for not following court orders.

Possibly. Depends how much is in writing and whether the failure directly caused the costs order.

BUT, I am unclear why the registry refused the filing. It should be filed and the court then decides what happens next. *wonders if NSW is different to VIC and Federal courts.

Write back to the Registry asking them under what act/provision they are refusing to accept your filing.
