Hey, I was wondering what is the law (Commercial Law or Australian Consumer Law?) of selling refurbished mobile phones and buying second-hand phones in Australia acting as a business?

You'll have to comply with Australian Consumer Law, which applies whether the product you're selling is new or second-hand. See:

Hey Michael thanks for that. In regards buying second hand phones, fixing them and selling, what must I declare or is there any licenses I should have?
