  • Purchased a car from a dealer. Over 10 years old.
  • Vehicle broke down under 1 month of purchase and is immobile. Mechanic diagnosed fault as major fault with transmission. quoted $4000+ to repair.
  • We later find that dealer did not provide a current pink slip at time of sale which they are required to as per the dealer act. After looking into it there was a pink slip registered the day after purchase (when the car was in our possession).
  • The dealer verbally assured us prior to purchase that a mechanic had thoroughly checked the vehicle and it had no mechanical issues and was in perfect condition.
  • Do we have a right to demand a full refund under the ACL as it's a major failure in a short time frame not meeting the acceptable quality (section 54)?
What would our chances be if we took this to NCAT?
