NSW Ripped off by a customer

My partner, a concretor, entered into a contract, with a customer to complete a shed slab for her new large shed. He was paid part payments as the job progressed. When complete, she asked him to wait until months end for final payment as she was selling another property. When that time had passed, he rang and was told all money had been paid and he wasn't getting any more, he was still owed more than $5,500, so he took her to court. In court, she went bankrupt and a property search revealed she wasn't the owner, the property was registered in someone else's name. A writ was executed on the property but that person doesn't live there and it is being rented privately by another party, they have no details of where the owner is. What is his best course of action from this point for my partner to recover outstanding money owed? Any and all help would be much appreciated

Not going to be easy to recover the money.

If a writ was issued sounds like your solicitor already has the matter in hand. You may want to consider placing a caveat on the property to protect your interest. The owner will be forced to deal with you when he goes to sell the property.

It sounds sus that a place is privately rented and the renter doesn't know who or where the owner is. Follow the money trail. Renter is paying money somewhere, find out where though you may need court orders to extract the information from the 3rd party.
