How about if we remove the top sleepers as they are not retaining any thing. Will that solve the issue. also the sleepers are in galvanized polls they can be taken off easily.

Logically, it should. But you’re dealing with a local council and sometimes logic can get screwy in those circumstances. Check with Council, before doing so, whether they consider that outcome acceptable. Get it in writing.

I'd take out the extra sleepers, take photos with measuring tape easily read in the photo, and say you now comply.
