Hi. My ex partner who has been driving a car registered in my name lost her drivers licence and almost mine also. She took the double or nothing option and within weeks, she reoffended. She's a serial offender having accrued over 30 infringements in approximately 6 months. Having reoffended on the double or nothing option, I sent statutory declarations declaring her as the driver. I know she got them as she very pleasantly let me know. She colluded with a friend to reissue the statutory declarations so she could maintain her licence.

Despite my reports, no action has ever occurred. It is a mandatory jail sentence for fraudulent stat decs. She has just recently crashed the car after losing control around a corner bursting the tyeares on a gutter then being hit by another vehicle with my 6 year old in the car. She is a menace on the road. Unsafe for other motorists, herself and anyone in the car with her. She should be in jail and my son safe. She has a clinically diagnosed mental health issue which she refuses to take medication for so is prone to massive mood swings, lying and depression. As well as serious neglect to my son and her other son from a previous marriage who has always been in trouble at school, bullying and even sexual harassment as a 13 year old.

My son is not safe with her and he suffers for it. No police will take action despite all the evidence. I'm worried for my son.

Any help would be great.

Hopefully, you still have a copy of your report/s and any other evidence previously provided to the WA Police to ensure a timely review of your complaint!

You may consider meeting with a family lawyer to discuss the issues raised in relation to your ex partner and the safety of your child. Thanks John. I will indeed use your advice. I've reported to every authoritative body in WA and they all tell me it's not their problem. Even the ombudsman came back with a similar reply. This woman is clinically diagnosed with a serious mental health issue and is a danger to anyone on the road not to mention in the car with her. She's a serial offender which is not likely to change. I just want to protect my son at any cost.

Continue to maintain a "paper trail" of all events.
Also consider sending the appropriate government departments/agencies a one page factual summary of all events to date (using bullet points and headings). Please keep us updated as to your progress - All the best.

Hi again John

I've now issued formal written complaints. Despite the irrefutable evidence they have told me that they cannot prove beyond reasonable doubt. I have questioned this bullet pointing the exact circumstances as they occurred. It seems so simple that it's almost laughable at the state of police negligence. She lost her license. Fact. Entered into double or nothing option. Fact. Re offended. Fact. Front on photo clear as crystal. Fact. At this point she should have already had her license removed and the appropriate fine for breaking the conditions of the double or nothing option she entered into. Fact. Re offended again. Same set of lights. From the rear this time. But she did receive and dealt with that infringement some how also. I'm told neither appear on her license. Fact. After my 20th attempt to report this finally that was the only information the infringement department have me. Conversed with several lawyers. All agreed that if she received them but that wasn't recorded on her license the only possible alternative was re issuing the stat decs to a friend willing to take the points so she could keep driving. Fact. I really can't see doubt at any point. Now she's ritten the car off after 2 crashes with my 6 year old in the car. He was the one to tell me. So there is no regard whatsoever for my sons safety. With All evidence presented on a platter in a formal complaint I've been told there's doubt. When asked to explain how they are not negligent the officer told me to complain to the CCC. This is ridiculous. The first re offense should have seen the infringement department immediately remove her license. But they didn't so she offended again. Nothing again. No matter who I call or talk to or what department there is never an answer. Even the ombudsman didn't look into it at my request. Are our traffic authorities this incompetent? It certainly seems so. The office refused to explain his so called doubt. When he just brushed me off and said contact the CCC. I'm pissed off royaly. I'll be sending this exact story to any media department that would like to make reference to it. Given the recent Bartlett incident with drink driving and not being charged either it would seem necessary after the media hype surrounding operation glyder and the obvious incompetence of the WA traffic authorities who I've had to explain the WA road traffic act to just to prove my point and tell these idiots exactly what part of the act she's breached and the mandated outcome for such an offense. I know far more about the WA road traffic act than the departments that are set up to police these laws. A gigantic waste of tax payers money. Abbott wants to make cuts. Start with all the incompetent negligent misinformed govt departments that don't even know the laws their supposed to be responsible for. I'm disgusted with Australian authorities. WA in particular but I've read lots of similar issues in other states also. It's no wonder Abbott ran away to the other side of the world. He's due to be linched. It's what he and Hockey deserve.

My ex partner is a habitual speeding offender. Approximately 2 years ago she lost her license due to over 40 infringements within 6 months. Took the double or nothing option and Reoffended 2 more times at red lights. 4 more points. Despite this and my reporting this over 20 times nothing ever happened and she continued to drive. Since then she has had 2 accidents with my 6 year old son in the car. The second severe enough to right the car off and see her license taken for 3 months. She was suspended at the time already. I've reported this to every WA road traffic authority dozens of times and always blown off. I reported formally which went to the CCC. Then I had an interview with WA infringement department to follow up. Their report was full of lies to clear the negligence of authorities despite I have all physical proof of these incidence. The CCC dropped the case despite my telling them the report by WA police was full of lies. She's been illegally keeping my son from me get this for a supposed issue with the safety of my driving. I who have a perfect driving record. She's done this to avoid paying me child support and to help my ex wife attempt to claim extra welfare benefits as she can't afford to raise my kids. All 3 of my kids are forced to suffer because of their mothers and their illegal removal of my childrens rights to attachment with their father. It's utter crap and no one seems to care. The CCC and WA authorities negligence could have killed my son. Yet they just closed the case despite my having all the evidence against them. What more can I do? My kids are suffering and they should be protected.

As an extra point my ex wife over 9 years over now is removing my children's rights illegally to their normal attachment needs and desires. Was always 50/50 for the last 9 years. She and my defacto ex have tried to collude to gain financial assistance and hurt me despite having no legal grounds. It seems that the system is set up to allow these disgusting women to abuse my children to obtain extra welfare as they can't afford to look after my kids. Despite my following all family court guidelines they can get away with doing whatever they want at my kids expense. All my kids are suffering depression and despite their wishes being expressed clearly that they would rather be with me they are being not only ignored but psychologically abused with a constant barrage of lies told to them about me. I'm belittled to my children directly and my kids are suffering. The govt doesn't care and it's costing me a fortune legally which is money I don't have just to get my kids where they want to be anyway and give them their rights back despite having them illegally removed. What is wrong with this system that kids should suffer at the hands of negligent parents?

Hi John.

Thank you for the links you sent me and your advice. I indeed did follow your advice and have sent off formal complaints. Due to the dissatisfaction of the replies I received my complaint went to the CCC and was then returned for further investigation and a follow up interview between myself and 2 senior officers at the department of infringements. This has resulted in a secondary report arising from that interview which contains blatant and deliberate lies to which I have all evidence as I was the provider of the evidence which this report claims I didn't provide any supporting evidence. The CCC choose to bury this case. I'm now attempting to see if I can locate a lawyer willing to take on the public officers and govt departments involved in what I can only see as deliberately false and misleading information. The reality was my ex partner was caught driving on a suspended license after being the cause of a serious traffic accident involving the endangering of a minor. I'm very thankful that my son wasn't hurt. Given the car was written off he very easily could have been. Having gone through the road traffic act and many legislature including recent judicial outcomes, I've located what appears to me to be the mandatory penalty for such an offence. That being an immediate loss of license for a 2.5 year time frame where no vehicle can even be accessible to her. Where this penalty removes the minor from ongoing danger and if seen as in the Childs best interests that said child would be required to be raised by the child's other parent in order to attend to their needs. Wondering your thoughts on this and any insights you might have as the CCC seem quite desperate to have this negligence buried.

Don't forget to take it up with the Department for Child Protection (DCP).
